Delta: Court Restrains Military from Invasion of Urhobo Community


LAGOS MARCH 3RD (URHOBOTODAY)-An Effurun High Court, presided over by Justice P. O. Onajite Kuejubola, has granted an order of interim injunction restraining the Nigerian Army, represented by Col. Ifeanyi Otu, Commanding Officer, 3rd Battalion Nigerian Army, Effurun Barracks, from further invading or marking for demolition Ohorhe communities in Uwvie kingdom.
Delivering a ruling in a suit last Friday between claimants/applicants – Godwin Imiruaye, Lucky Utebu and Chief Julius Oghojamumi, and Col. Ifeany Otu, Capt. Muhammed Abdulahi, Operations Officer, Attorney-General/Commissioner for Justice, Delta State, Attorney General of the Federation and Minister of Justice, Chief of Army Staff, Chief of Naval Staff, and Chief of Defence Staff, as defendant respondents, Justice Kuejubola granted an order to give leave to claimants/applicants to serve all court processes, including originating summons, motion or notice for interlocutory injunction on any of the officers.
The order reads: “Invariably therefore, the prayers are granted as prayed: an order of interim injunction is hereby made restraining the defendants, particularly first and second defendants and their agents, including any other person of interest through them, from further invasion of the claimants’ communities under the guise to mark for demolition without due process of law. This includes claimant properties, ancestral homes, and residential promises pending the hearing and determination of the motion on notice.”
Justice Kuejobola also ordered that the claimant can issue or effect service of all court processes including originating process and motion on notice on the 4th, 5th, 6th and 7th defendants and adjourned to 10th and 31st of March 2014 respectively for a return date.
