Unlawful Detention: Okumagba Sues Warri Divisional Police Officer for N5m

LAGOS OCTOBER 11YH (URHOBOTODAY)-Olorogun Victor Okumagba has sued the CSP Aniette Eyoh, Divisional Police Officer, B-Division, Warri N5Million over unlawful detention, before a Federal High Court in Warri.
In Suit No. EHC/W/CS/ dated 11th of September, 2015, Olorogun Okumagba is suing the Police Officer of unlawful detention, molestation, oppression, brutalization, alleged forcefully taken his N85,000 Nokia E90 Phone, a Blackberry Classic Phone and his medical recommended eye glasses by the police.

Adding that despite his release and petition from the law firm of Oghenejabor Ikimi to Mr. Mike Okiro, Chairman, Police Service Commission to the DPO to return his stolen items proved abortive consequently upon he is suing CSP Aniette Eyoh for N5 Million as general and special damages.
In a wit of summons, which was served on the Defendant (CSP Aniette Eyoh), Dr. Dele Alufe, counsel to the plaintiff is seeking 7 reliefs from the Federal High Court, the return of plaintiff N85,000 forcefully and allegedly taken from him by men of the Nigerian Police Force at B-Division on 15th August, 2015 and order the court compelling the defendants to return back the applicants two phones, a Nokia E90 and a Blackberry Classic, also his medical recommended eye glasses, rendering of an unreserved apology to the plaintiff for the violation of his fundamental human rights for his unlawful detention, also an order asking the defendants to pay N5 million as general and special damages. 10% interest on the total judgment sum until the judgment debt is fully liquidated and any other deem fit by the court.
In a sworn affidavit depose at the Federal High Court in Warri by the Plaintiff, endorsed by his counsel, Dr. Dele Alufe, for Alufe & Alufe (Elohim Chambers) stated that Olorogun Victor Okumagba was phoned by his younger brother, Ojarikrie, that both Chiefs Keseinna and Gideon Okumagba were detained by Officer and men of B-Division of Nigerian Police Force, adding that Chief Gideon
Okumagba was arrested when he went to go and inquire passionately bail his brother, Chief Kesienna allegedly detained on the order of the DPO.
The plaintiff (Victor Okumagba) said he too was detained with his two elder brothers for having the effrontery to ask and attempted to bail them adding that in the process of been taught a lesson, he was “pushed, slapped, molested, abused, verbally manhandled harassed, oppressed and his clothes were squeezed and rough handled on his body before he was finally locked up like his two brothers who were still wondering what their offences were”.
The plaintiff, Olorogun Victor Okumagba said “It took the intervention of women and children crying, kneeling down and begging the 1st defendant, CSP Aniette Eyoh under the rain because the other men in the family were now afraid to come before the 1st defendant reluctantly ordered the release of the plaintiff and one of his elder brother, Chief Gideon Okumagba.”
The plaintiff said he went to brief the law firm of Ikimi Oghenejabor and to write a petition which was duly signed by Oghenejabor Ikimi Esq. dated 27th August, 2015 to Mr. Mike Okiro, Chairman, Police Service Commission when a pleas demands and it become clears that plaintiffs money N85,000, a Nokia E90 phone and Blackberry classic phone and his medical glasses “forcefully taken” up till now I am yet to get back my money (N85,000) and items, 2 phones, medical glasses, collected from me.”
Meanwhile apart from Olorogun Victor Okumagba, who also said he is very prepare to testify all the allegations against the defendants in the court, so also we, Chief Gideon Okumagba and Prince John Edgar Eranvoh, who said in sworn affidavit before the Commissioner of Oath, that actually the plaintiff and his brothers were detained by the police at B-Division in Warri “unlawfully”. And he was called to come and bail them” adding that it was indeed the intervention and the crying of women and children, “All over the place and it than that realized that it was based on their plea, that the plaintiff and Chief Gideon Okumagba were been released and they needed a neutral person to take them on bail” but the plaintiff refused to go because the money and items collected from him were not given back to him.”
No date has been fix for hearing, Olorogun Victor Okumagba is Plaintiff while CSP Aniette Eyoh, DPO B-Division Warri, Nigeria Police Force, Nigeria Police Service Commission, Inspector General of Police are the defendants.
Meanwhile leaders from the 3 ruling Houses of Okere-Urhobo Kingdom have petitioned the Inspector General of Police through the Delta State Commissioner of Police, seeking the removal and discreet investigation of the CSP Aniette Eyoh, before now accusing him of allegedly taking side with one of the leadership factions in the community.
