Delta Assembly Poll: Igbuya in Trouble as APC Candidate Floors Him at Appeal Court
LAGOS SEPTEMBER 24TH (URHOBOTODAY)-The embattle Speaker of Delta House of Assembly, Hon Monday Igbuya yesterday failed to satisfy the Court of Appeal sitting in Benin City, Edo Sat, e why his appeal against the ruling of the National and State House of Assembly Tribunal which threw out his motion on notice to strike out or dismiss the petition by the candidate of All rpgressive Congress (APC) in the last Sapele Constituency election of Chief Felix Anirah of being “fundamental defective and accruably incomepetent.”
The appellant court which dismissed the Speaker’s appeal yesterday hinged the ground for the dismissal on “ That the time frame statutorily allowed for hearing and delivery for judgment on the appeal is 60 days days whereas a total of 57 days instead of statutory 10 days have been spent by the appellant , yet he has not been able to successfully complete the transformation of his appeal. Processes from the tribunal to the appellant court”, saying, ” Only three days from today is left even as they fall within public holidays.”
The court also threw out Chief Igbuya request for extension of time to complete the transmission of his appeal processes from the tribunal to the appellate court, saying, “ Time is of great essence in hearing and determining both the petition and present appeal in line with the statutory stipulated time.”
