Appeal Court Sacks Delta Lawmaker

LAGOS DECEMBER 19TH (URHOBOTODAY)-The Court of Appeal sitting in Benin city, Edo State, has sacked the member representing Aniocha North constituency at the Delta State House of Assembly, Mr. Osi Okocha of the Accord Party and ordered that Mr. Emeka Nwaobi of the People’s Democratic Party, PDP be sworn-in as the legitimate winner of the April 11, 2014 House of Assembly polls.
Mr Emeka Nwaobi had been in legal battle with Mr. Osi Okocha over his victory at the April 2014 election and lower tribunal.
Delivering the judgment on the petition brought before it by Mr.Emeka Nwaobi of the PDP, Justice H. A. Barka, upturned the judgment of the lower tribunal which had upheld the election of Mr Osi Okocha at the polls.
Barka said the Accord Party failed to give the 21 days mandatory notice to the Independent National
Electoral Commission, INEC, on the selection of candidates as stipulated in the 2011 Electoral Act. He noted that the Accord Party gave 12 days notice instead of 21 for the conduct of its primary election where Mr Osi Okocha emerged as its candidate for the House Assembly election.
